Terms of Service

1. Acceptance of Terms

By accessing or using RoomMooch ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

RoomMooch is a platform that connects travelers ("Roomers") who have spare space in their hotel bookings with other travelers ("Moochers") seeking accommodation. RoomMooch facilitates introductions but is not a party to any agreement between users.

3. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use RoomMooch. By using the Platform, you represent that you meet these requirements.

4. Account Registration

  • You must provide accurate, complete information during registration.
  • You are responsible for maintaining the security of your account.
  • You must complete identity verification to access full features.
  • One account per person; duplicate accounts may be terminated.

5. Verification Fees

  • Roomers pay a one-time verification fee of $0.99 USD.
  • Moochers pay a one-time verification fee of $1.99 USD.
  • Verification fees are non-refundable.
  • Fees cover identity verification processing costs.

6. User Conduct

You agree not to:

  • Provide false or misleading information
  • Use the Platform for illegal purposes
  • Harass, abuse, or harm other users
  • Circumvent security measures or verification requirements
  • Scrape, copy, or redistribute Platform content
  • Create multiple accounts to evade bans or restrictions

7. Listings and Bookings

  • Roomers must have valid hotel bookings to create listings.
  • Roomers must ensure they have the right to share their accommodation.
  • All listing information must be accurate and current.
  • RoomMooch does not guarantee the accuracy of any listing.

8. Payments and Fees

  • All payments are processed through Stripe.
  • Card information is stored securely by Stripe, not RoomMooch.
  • Pre-authorizations may be placed on cards as security deposits.
  • Charges for damages are subject to our dispute resolution process.

9. Cancellations

  • Users may cancel pending requests at any time.
  • Excessive cancellations may result in account restrictions.
  • Verification fees are not refundable upon cancellation.

10. Limitation of Liability

RoomMooch is a platform that connects users. We are not responsible for:

  • The quality, safety, or legality of accommodations
  • The accuracy of listing information
  • The conduct of any user
  • Any damages arising from use of the Platform
  • Disputes between users

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOMMOOCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless RoomMooch, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

12. Dispute Resolution

Any disputes arising from these Terms or use of the Platform shall be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA).

13. Termination

We may suspend or terminate your account at any time, with or without cause. Upon termination, your right to use the Platform ceases immediately.

14. Changes to Terms

We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
